AFSPA muddle

i am contemplating, is the Jan Karwan , mislead or ....Misleading!

The Maolm incident which started this debate was indeed unfortunate. In all probabilities a paroxysmal stress reaction by Assam Rifle troops on being ambushed by some unknown miscreant. Nevertheless, the unwarranted loss of life can not be discounted, and the law must take it in just stride.

Heirangoithong massacre occurred due to overreacting CRPF troops.

These incidents are unfortunate, yet a verdict without seeing the other face of the coin will be unfair. These troops undergo tremendous emotional agony in their prolonged deployment in hostile environment. The factor of hostility is a product of distrust between the people and police...

Now firstly CRPF, ASSAM RIFLES and State Police do not require AFSPA to operate. Mandated to maintain law and order, they act under Ministry of Home Affairs guided by tenets of IPC and CRPC.

AFSPA is aplicable only to the Army and other forces of Ministry of Defence which are trained as a lethal instrument of state against foreign aggression. And the so called "Draconian Law ," only provides legal cover to Army to act in Aid to civil authority.

It gives no licensee to kill to anyone. Each arrest, made under its provision is to be explained and Human Rights of the arrestee are to be respected. it proscribes any form of torture and a medical examination of the arrestee is must.

and if a death does occurs due to abuse or mishandling, it is triable by a court of law. It is just the summon has to be guided through central government.

So will a dilution of this law , or repeal make any difference? i do not think so.

....i wonder how easily people accept misinformation on face value.

Singapore Feel Good Factor

Everybody is posting the Singapore Feel Good Factor without analyzing it. Please conceder what is posted below to make an informed decision...

Singapore can be an example we should emulate.

But if we see it rationally in sheer numbers our 60 % literacy figures will be much higher than those of 92 % in Singapore. 90% white money can be attributes to the moderate taxation slabs. Singapore produces nothing, it is a service oriented economy , people have migrated to Singapore for the jobs there exceed indigenous population, hence 99% employment...

Naturally with education and employment comes prosperity and civic sense...

The progress of Singapore is a cumulative result of years of hard work by its people.

Population of India 1.2 Billion and that of Singapore as of 2010, 5.1 million people.

Geographic area of India is 3,287,263 square kilometres (1,269,219 sq mi) and that of Singapore is 704 km2 (272 sq mi).

can there be comparison?

If this is an example we need to follow, why not follow example of Saudi Arabia

In Saudi Arabia we have Shariat Courts which are empowered to award physical punishments such as beheading, stoning, amputation and lashing...which works as effective deterrence and checks crime rate.

...On Kasab and Compassion

... a lot of questions have been asked. More curses have been sworn at me . Friends and strangers alike have expressed their dismay that how can i stoop so low, so as to even think about forgiveness for Kasab... To began with ,i,am not surprised at the reaction. It was anticipate ...i am contended, that i was able to ruffle a few conscious.

..Pakistan, was a result of perceiver insecurity of Muslim elite in pre partition India. The issue was further compounded by the ambitions of those at the helm of affairs. As a bargain, the lust for power was paid by tearing apart of a nation called India. Those who found themselves incapable to savor the spoils, set the nation ablaze with hatred. The blood which flowed in the  Sutluj washed away the collective memories that formed the bedrock of India.

What happend in Kashmir was a result of trust deficit between the League and Congress. The decision to join  India or Pakistan was a sovereign right of Maharaja of Kashmir.Anticipating his tilt towards India, League tripped the wire, creating conditions wherein Maharaja of Kashmir was compelled to accede to Union of India. What happened thereafter was a battle of bruised egos. Jinnah vs Nehru, Liyakat Ali Vs Patel.Of course the erstwhile brothers- in -arms of British Indian Army were engaged to prove their superiority.

The  events in Junagadh, Hydrabad and Goa deepened the insecurity in Pakistan.A common Pakistani was made to feel that the Indian Union will never accept Pakistan as an equal. This was further aggravated  by events which lead to partition of Pakistan and securing of  Baltaro Ridge by Indian Army.

At the same time generation after generation of Indian Union was brought up with inherent hatred for Pakistan. Across the border the Military Machine of Pakistan kept feeding the common people on the staple of venom for India. It was due to this propagated hatred that diabolic actions in Kashmir and elsewhere in the hinterland of Indian union were justified. The Pakistani propaganda machinery was successfully able to sell to the people of Pakistan that Islam is jeopardized in the land across Sutlej. Events, in Indian hinterland , gave them sufficient credibility.

In such circumstances was Azmal Kasab born.

We have hated each other for 63 years. Fought 4 wars. Starved our generations, deprived them of education to build Atom Bombs. Siphoned billions from basic necessities of life to buy hi tech weaponry. Yet a solution is nowhere in sight.

i am waiting for the child who will tell the king that he is naked...

It is common sense that we need to change our approach...Time is ripe for  the people of India, Hindustan... on both sides of Radcliffe Wrath to carry out introspection...As Indians we must ask our selves that what we have done to assure  a common Pakistani that he is secure. Pakistan is turing water deficit and we can not turn a blind eye. There is a requirement to generate jobs. While we have reached far East to Vietnam, have we offered IT education initiatives to Pakistan in required magnitudes.Have we ever thought about investing our prosperity in Pakistan? Have we even tried  to assure Pakistan Army to focus on West, guaranteeing peace in Eastern borders?

We were shamefully late to offer aid when Pakistan was struggling with the massive floods in 2010. Even then it was too late and too less.  We may be separate countries, but we are One Nation.

We must acknowledge Pakistan as our equal . We must behave like a responsible neighbor and share the pain of people of Pakistan.

From the People of Pakistan it is expected that they acknowledge the genuineness of this effort. If possible rally masses to impress upon their government to stop supporting terrorism, in name of Isalm  across the Sutlej.

A peaceful Pakistan is a key to peaceful India. We need a de-novo "Understand West Policy."

There may be questions  about the Confidence Building Measures. These  wont work with the trust deficit we have between us. We need to inculcate faith in each other. For that we need Faith Building Measures.

Forgiveness to Kasab is a token of  faith....

...LETS FORGIVE KASAB

Mohammad Azmal Kasab
you came
with hatred in your eyes
and vengeance in your heart
blinded by distorted belief
to kill fellow humans
and uphold the fallacy of faith
with one act
of cold violence
you brought dishonor
to humanity
and annihilated the divine drop
that dwelt within you
your god
overwhelmed with the sinful obscurity of your deeds
he seeks deliverance
... for the wrath you rained upon us
we offer a prayer
...for the bestiality you displayed
we offer you humanity
...for the lives we lost
we give you yours
.. for the hatred that hallmarks you
we forgive you
let peace be upon you

how " Jan..." is Jan Lokpal

how to define corruption...

is it an act of...commission;or an act of omission..?
is it born of greed;or born out of need..?
where is the fine line that divides privileges and graft..?
is only the receiver of graft guilty , or is it the giver who is also equally responsible..?
is the definition , if we have any ,dynamic in nature , which changes with time and circumstances..?

with many more questions in mind i, implore you to deliberate upon some issues which touch our daily lives...

is bribing a TTE  to get a berth for ones pregnant wife ...corruption?

or paying hush money to a blood bank employee to obtain o-ve blood for ones dying brother corruption?

is paying an auto ricksha driver over and above the meter to ensure that one reaches the railway station in time corruption?

is buying LPG from black market to ensure your children get their meals in time , corruption?is buying PDS kerosine in black to ensure profit , to pay for the exorbitant fees for the so called "international school" your children study in , corruption?

is sending your children for tuition at home of his class teacher corruption?

does jumping a red light habitually amounts to corruption?

is blocking a free left turn corruption?

ignoring the people standing in a que  does going to the ticket window corruption ?

is use of official vehicle for shopping corruption?

is accepting a gift from you subordinate on festivals corruption?

is paying your house maid peanuts, corruption?

is running a commercial establishment form a residential area corruption?is copying in exam corruption?

is charging 50 Rs for an article costing 49.78 Rs corruption? Is not giving the bill for same of instead of change returning sweet corruption?

is claiming bogus TA/ DA  corruption?

is going late to office, extending lunch hours, and breaking off early , corruption?

the list is long , and the more i brood over it , i realize more corrupt i am.

Life is full of shades of Grey. The only thing which is black or white is character.

now may i ask, those who support the Jan Lokpal, how does the bill intended to address these invisible issues imbedded in our daily lives.

institutional corruption does not touch me now and then, and the existing framework of Indian Constitution can be effectively used to contain it...

provided we have character....

braising janlokpal bill

i do not agree to the methods being employed by the "famous five," Team Anna. It is a coercion of democracy , and that is is. i know i will be called a " psudo -intellectual," or maybe a " traitor," by those who blindly follow the movement. So be it , i am not ashamed of it. As a citizen of a democratic nation i have a right to dissent.

The first and foremost question is does this Nation really needs a Lokpal. The constitution of India rests our democracy on four pillars . The Legislature , The Executive , The Judiciary and the Media. Each , independent of the other works as a homeostasis measure. But this is theory, in practice there is a nexus of necessity between these elements. Each accommodates the other for selfish interests at cost of the nation.

The legislatures suffers from vote bank syndrome, populist politics woo the innocent voters. Then there is a constant need of un accountable cash to feed the electoral system. There have been so many cases , in each and every political party where party tickets have been purchased by payment. The question is why till date no political party has addressed this issue. Now what role will lokpal play in the internal matter of a political party?

So, if you invest Rs 5 Carore to purchase the Ticket, another two to influence the outcome, you will by all means make profit. Then the executive is pressed for remittence. The lust to grow in stature and influence keeps the executive going. In 60 years has any member of executive resigned on these grounds. The answer is no. The executive extorts the money from the man on the street . And he rationalizes his losses with his kith and kin. The judiciary becomes a party in the loot to cover up their political master and colleagues. It is a win win situation for all.The press over the period of time has learned the art of blackmail. After all the welth needs to be equally distributed.

All of us are part of this system. And the so called Lokpal will be made up of the same stock. So where is the change?

Has any one of us been so resolute to sacrifice his self interest and said no to bribe. From the auto driver on street who refuses to charge by meter , to the tutor who prepare our children for becoming a part of this system. It is us who pay to touts or TT to confirm our reservation and take visit the government doctor in his private clinic who encourage corruption. We need a lokpal for our conscious.

Yes there is a need to check institutional corruption. And this can be done by strengthening out existing constitutional provisions . There is a need to reform the electoral process. Make the party activities transparent. Disjoint the Nexus of necessity between the pillars of democracy and establish their independent character. Educate the electorate , and make sure each one of us  vote.

It all begins with me...

Anna and aam Admi

Anna is resolute. He would settle for nothing less than realisation of Lokpal Bill. The country is upbeat and thousands pour their support to his pledge. They agree to him wholeheartedly that the system is corrupt and needs a change. They sing in chorus to pointing fingers at the moldy system. In this din, the quintessence gets deluded; it is them who make this system.

The system is corrupt – when i am the giver. On my way to work,i over speed, do erratic lane hopping and jump a red light. i get caught and choose to bribe rater than getting booked. i come home and remark the system is corrupt. i conveniently forget that for ever act i attribute to corrupt system , i have overlooked the countless deeds i have done with an unconscious mind, for now, i will plead ignorance that whati did amounts to corruption.

i wonder what Lokpal is going to achieve when the constituent fabric is fetid.

We are a breed of self-centered people who would defy any social logic for own gratification. To add beauty to it we have realized the corrective power of democracy. The Gujjar and Jat reservation issues are current case in point, wherein the nation is held to ransom for achieving political mileage. Ask any one who participated in these agitations and he will take no time to point at the failing system. He will certainly glorify his act of anarchy. Anna draws support from these quarters too.

Of course the Maharashtra Navnirman Sena needs a special mention. They are the ones who refined the art of fast track political emergence. With sheer nuisance as investment they became a political entity which can not be ignored. The people who vote for them do support Anna wholeheartedly.

Of course, how can I forget Behan Mayawati an explicit case of rags to riches. The jewelry she adorns to display her machismo would throw Godess Padmawati (Consort of Lord Balaji) into a vortex of inferiority complex. Did the people who support her ask her that from where has a gareeb ki beti amassed so much of wealth without a justified enterprise. I am sure they would have fasted for Anna.

Dr Manmohan Singh also supports Anna. (I am sure if reincarnation exists, he was Dhritrashtra in his previous birth.) He blames constrains of collation politics for his incapacity to act. I agree with him to certain extent, but if he is so much a man of unimpeachable ideals, what prevents him from resigning from the system he heads. Of course he is a lesser mortal like all of us. System for him too is corrupt when he is at receiving end.

Majority of our esteemed legislators and parliamentarians have a criminal background. We desist it, hate it, abhor politics and stay away from it in all forms-from participating in elections to casting our votes. The intellectuals of the country who should be formulating the policies of the country have made politics a taboo for themselves. You only have a choice to select the lesser evil. Of course the intellectuals support Anna with bottom of their heart.
